These Terms govern access to Legend and the invitation-based First Passage program. By creating an account or entering the program, you agree to these Terms and acknowledge the Privacy Policy.

Eligibility and accounts

First Passage is for adults age 18 or older. Use one account for yourself, keep its credentials secure, and provide accurate information. Invitations are personal, revocable, and may not be sold or transferred.

The game

Legend is an authored survival role-playing game. It includes fictional peril, violence, lasting consequences, and final death within a run. Runs use recorded seeds and deterministic rules. Hyper Garden may repair, replace, or retire pre-release builds while preserving the records required to reproduce accepted play evidence.

Run credits

A run credit is a nontransferable entitlement to create one new server-authorized run. Resuming an existing run does not cost another credit. Credits are not legal tender, stored value, a wager, a prize, or a claim on a particular ending. They have no cash-out value and cannot be traded.

Payment never changes odds, difficulty, story truth, or survival outcome. Legend sells no loot box, cash prize, or paid advantage. Ordinary death or abandonment after a run is durably created is a game outcome, not a failure to deliver the run.

First Passage

Accepted First Passage members receive three complimentary run credits in total: one account credit and two program credits. The program asks for candid feedback and may change or close. Complimentary credits have no cash value and are not refundable.

Paid access

Paid checkout is not currently available. If it opens, the exact quantity, price, currency, tax treatment, immediate-delivery terms, and refund route will be shown before purchase. Paddle will act as Merchant of Record for supported paid transactions. Paddle's buyer terms, refund process, and mandatory local consumer rights will apply alongside the product terms shown at checkout.

Acceptable use

Do not compromise accounts, probe protected systems, automate play or feedback deceptively, interfere with other players, evade access controls, scrape private content, or use Legend in a way that is unlawful or abusive. The Acceptable Use Policy is part of these Terms.

Feedback and intellectual property

Legend, its software, text, art, marks, and game materials belong to Hyper Garden or its licensors. You receive a limited, personal, revocable right to use the hosted service. You keep ownership of your feedback and grant Hyper Garden permission to use it to evaluate and improve Legend without identifying you publicly unless you separately agree.

Availability and termination

Pre-release access is provided as available. Hyper Garden may suspend access to protect players, the service, or the integrity of the program, and may terminate accounts that violate these Terms. Where practical, durable purchased entitlements will be handled under the published Refund Policy and mandatory law.

Disclaimers and liability

To the maximum extent permitted by law, the pre-release service is provided without guarantees of uninterrupted availability or fitness for a particular purpose. Hyper Garden is not liable for indirect or consequential loss. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

Changes and disputes

Material changes will receive a new effective date. These Terms do not select a forum or governing-law rule that overrides mandatory consumer law. Any commercial dispute posture added before paid checkout will be published before a buyer is asked to accept it.
